M I N U T E S

December 14, 1999

 

A Regular Meeting of the Mayor and Council of the Borough of Hasbrouck Heights was held on December 14, 1999 at 8:00 p.m. in the Masonic Hall, 200 Division Avenue, corner of the Boulevard, Hasbrouck Heights, New Jersey

Mayor Torre stated that the meeting complied with the Sunshine Law, due notice having been made to all members of the Council by personal service on January 1, 1999 and transmitted to The Observer, The Record and the Herald News on January 4, 1999.

ROLL CALL: Present: Mayor William J. Torre, Councilman Andrew Link III, Councilman Herbert D. Heeren, Councilman Justin DiPisa, Councilman Garrett Pepe, `Councilwoman Marlene Verrastro, and Councilman John Wassberg

Salute to the Flag and Pledge of Allegiance: Mayor Torre led in the Salute to the Flag and Pledge of Allegiance.

Prayer

 

MAYOR AND COUNCIL:

This was the first meeting held after the tragedy of the plane crash on Central Avenue on December 8, 1999 and the fire at the Municipal Building on December 10, 1999. The room was filled to capacity. Mayor Torre and the council members each spoke, thanking the Police Department, the Fire Department, the Department of Public Works, and the Borough employees, in particular Michael Kronyak, for their support and assistance first on December 8, 1999 when an airplane crashed on Central Avenue, killing its four passengers, and again on December 10, 1999 when a fire caused the terrible destruction of the Municipal Building. When Mayor Torre spoke, he asked that all Borough employees stand and they were given a round of applause. He then asked if anyone from the audience wished to speak. Assemblywoman Rose Heck came forward and added her comments to those already made.

 

OATH OF OFFICE TO PROBATIONARY PATROLMEN:

Next on the agenda was Mayor Torre administering the Oath of Office to Probationary Patrolmen, Michael Colaneri Jr. and Brian Donohue effective December 17, 1999. Each came forward, with their families surrounding them, and applause and pictures followed. Former Captain Ronald Jones, representing John Ferguson, president of Hackensack University Medical Center, presented a check in the amount of $1,500 to be added to the Police Vest Fund in honor of the probationary patrolmen, who had previously been employed by Hackensack University Medical Center

On a motion by Councilman DiPisa, seconded by Councilman Heeren, and unanimously carried, the aforementioned Probationary Patrolmen were approved.

 

OATH OF OFFICE TO SERGEANTS:

The Oath of Office was then administered by Mayor Torre to newly promoted Sergeants of Police, James Krisinski, John Mullins, and Thomas Tozzi. Each came forward, accompanied by their families.

On a motion by Councilman DiPisa, seconded by Councilman Heeren, with all in favor, the aforementioned Promotions were approved.

The Mayor then announced that anyone wanting to leave could do so at that time.

 

COMMUNICATIONS: None

 

APPROVAL OF MINUTES: (November 23, 1999)

On motion by Councilman Heeren, seconded by Councilman Wassberg, and unanimously carried, the Minutes of the foregoing meeting was approved.

 

BILLS:

BE IT RESOLVED that the claims and accounts amounting to $1,361,273.66 specified in the schedule, having been examined and approved by the Finance Commissioner, or his Deputy, be paid and the warrants be issued therefor.

On motion by Councilman Pepe, seconded by Councilman DiPisa, and unanimously carried, the foregoing Resolutions were adopted. (Resolutions attached)

On motion by Councilman Pepe, seconded by Councilman DiPisa, and unanimously carried,the foregoing appointments were accepted.

 

Resignation: Frank Pistilli from Fire Company No. 2

On motion by Councilman Pepe, seconded by Councilman DiPisa, and unanimously carried, the foregoing resignation was accepted.

 

ORDINANCE(S) ON INTRODUCTION: None

 

ORDINANCE(S) ON CONTINUED PUBLIC HEARING:

ORDINANCE NO. 1879:

Mayor Torre opened the meeting to the public for anyone wishing to speak on Ordinance No. 1879. There being no one wishing to speak, Mayor Torre closed the meeting to the public.

 

"AN ORDINANCE TO AMEND AND SUPPLEMENT CHAPTER 271 ENTITLED "TOWING OF VEHICLES" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS SO AS TO PROVIDE FOR A DEADLINE FOR THE FILING OF APPLICATIONS, TO CHANGE THE REQUIREMENTS FOR QUALIFICATION OF APPROVED TOWERS AND TO AMEND THE FEES THAN AN APPROVED TOWER MAY CHARGE" be now continued on public hearing and final reading and the Borough Clerk be and is hereby authorized and directed to publish said Ordinance, same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

On motion by Councilman DiPisa, seconded by Councilman Pepe, the foregoing Ordinance on Continued Public Hearing was adopted.

 

ORDINANCE(S) ON PUBLIC HEARING:

Mayor Torre opened the meeting to the public for anyone wishing to speak on Ordinances No. 1880, 1881, 1882, and 1883. There being no one wishing to speak, Mayor Torre closed the meeting to the public.

 

ORDINANCE NO. 1880:

"AN ORDINANCE TO AMEND AN ORDINANCE ENTITLED "AN ORDINANCE TO FIX THE SALARY AND COMPENSATION OF CERTAIN OF THE OFFICERS AND EMPLOYEES OF THE BOROUGH OF HASBROUCK HEIGHTS, NEW JERSEY, FOR THE YEAR 1999" be now passed on second and final reading and the Borough Clerk be and is hereby authorized and directed to publish said Ordinance, same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

 

ORDINANCE NO. 1881:

"AN ORDINANCE AMENDING CHAPTER 275 ENTITLED "ZONING" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS BY REPEALING REFERENCES TO "PROFESSIONAL RESIDENTS" IN THE SCHEDULE OF DISTRICT USE REGULATIONS AS PERMITTED ACCESSORY USES IN THE SIX (6) RESIDENTIAL ZONES, REPEALING SECTION 21F WHICH SET FORTH THE CONDITIONS IMPOSED UPON SUCH RESIDENT PROFESSIONAL USES AND REPEALING THE DEFINITION OF "RESIDENT PROFESSIONAL" CONTAINED IN SECTION 6 be now passed on second and final reading and the Borough Clerk be and is hereby authorized and directed to publish said Ordinance, same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

 

 

ORDINANCE NO. 1882:

"AN ORDINANCE TO AMEND AND SUPPLEMENT AN ORDINANCE ENTITLED "AN ORDINANCE TO PROVIDE FOR THE SUBDIVISION OF LAND AND SITE PLAN REVIEW OF DEVELOPMENTS WITHIN THE BOROUGH OF HASBROUCK HEIGHTS PURSUANT TO THE MUNICIPAL LAND USE LAW," adopted on March 23, 1987, AS THE SAME HAS BEEN HITHERTO AMENDED AND SUPPLEMENTED be now passed on second and final reading and the Borough Clerk be and is hereby authorized and directed to publish said Ordinance, same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

 

ORDINANCE NO. 1883:

"AN ORDINANCE TO SUPPLEMENT SECTION 275-20 ENTITLED "REGULATIONS GOVERNING CERTAIN PRINCIPAL USES" AND SUPPLEMENTING SCHEDULE I ENTITLED "SCHEDULE OF DISTRICT USE REGULATIONS: BOTH OF CHAPTER 275 ENTITLED "ZONING" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS SO AS TO PERMIT WITHIN CERTAIN LIMITED AREAS OF THE B-1 CENTRAL BUSINESS DISTRICT FARMER'S MARKETS SPONSORED AND APPROVED BY THE NEW JERSEY DEPARTMENT OF AGRICULTURE AND BY THE HASBROUCK HEIGHTS CHAMBER OF COMMERCE BETWEEN THE HOURS OF 10:00 A.M. AND 8:00 P.M. ONE DAY OF ANY WEEK EXCLUSIVE OF SATURDAY AND SUNDAY BETWEEN JUNE 15 AND OCTOBER 31 OF ANY YEAR AFTER APPROVAL OF THE SAME BY THE GOVERNING BODY, THE CHIEF OF POLICE AND THE BOARD OF HEALTH be now passed on second and final reading and the Borough Clerk be and is hereby authorized and directed to publish said Ordinance, same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

On motion by Councilman DiPisa, seconded by Councilman Pepe, and unanimously caried, the foregoing Ordinances on Public Hearing were adopted.
