BOROUGH OF HASBROUCK HEIGHTS

M I N U T E S

April 13, 1999

A Regular Meeting of the Mayor and Council of the Borough of Hasbrouck Heights was held on April 13, 1999 at 8:00 p.m. in the Council Chambers of the Municipal Building, 248 Hamilton Avenue, Hasbrouck Heights, New Jersey.

Mayor Torre stated that the meeting complied with the Sunshine Law, due notice having been made to all members of the Council by personal service on January 1, 1999 and to The Observer, The Record and the Herald News on January 4, 1999.

ROLL CALL: Present: Mayor William J. Torre, Councilman Andrew Link III, Councilman Justin A. DiPisa, Councilman Garrett R. Pepe, Councilwoman Marlene Verrastro, Councilman John Wassberg

Absent: None

 

SALUTE TO FLAG: Mayor Torre led in the Salute to the Flag.

 

BILLS:

BE IT RESOLVED that the claims and accounts amounting to $1,290,827.79 specified in the schedule, having been examined and approved by the Finance Commissioner, or his Deputy, be paid and that warrants be issued therefor.

Councilwoman Verrastro motioned, seconded by Councilman DiPisa, to approve the foregoing Resolution.

Nayes: None

On motion by Councilman DiPisa, seconded by Councilman Heeren, and unanimously carried, to adopted the foregoing Resolutions. (Resolutions attached)

Elizabeth Conner - Fire fighter, Hook & Ladder Co.

On motion by Councilman Pepe, seconded by Councilman DiPisa, and unanimously carried, the foregoing resignations were accepted with regret.

Appointments: Heights Night Millennium 2000 Committee (see attached list)

Michael Thomasey - Fire fighter, Engine Co. No. 2

On motion by Councilman Pepe, seconded by Councilman DiPisa, and unanimously carried, the foregoing appointments were made.

 

ORDINANCE(S) ON INTRODUCTION:

ORDINANCE NO. 1853:

BE IT RESOLVED that an Ordinance entitled "AN ORDINANCE TO SUPPLEMENT SECTION 4 ENTITLED "SWEEPING LITTER INTO GUTTERS" OF CHAPTER 178 ENTITLED "LITTERING" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS SO AS TO SPECIFICALLY PROHIBIT THE DEPOSIT OF GRASS AND LEAF REFUSE IN ANY ROADWAY EXCEPT AS MAY BE REQUIRED FOR ITS COLLECTION IN ACCORDANCE WITH AND UNDER THE TERMS OF CHAPTER 152" introduced this date be and the same is hereby passed on first reading and the Borough Clerk be directed to advertise notice of public hearing on said Ordinance to be held at the regular meeting of the Borough Council on April 27, 1999 at 8:00 p.m.

On motion by Councilman Pepe, seconded by Councilwoman Verrastro, and unanimously carried, the foregoing ordinance for introduction was approved.

 

ORDINANCE(S) ON PUBLIC HEARING:

Mayor Torre opened the meeting to the public for anyone wishing to speak on Ordinance Nos. 1848, 1949 and 1850. There being no one wishing to speak, Mayor Torre closed the public hearing on said ordinances.

ORDINANCE NO. 1848:

BE IT RESOLVED that an Ordinance entitled "AN ORDINANCE TO APPROPRIATE THE TOTAL SUM OF $60,000.00, CONSISTING OF $45,000.00 PROVIDED BY THE NEW JERSEY DEPARTMENT OF TRANSPORTATION, BUREAU OF LOCAL AID, UNDER THE NEW JERSEY TRANSPORTATION TRUST FUND AUTHORITY ACT AND $15,000.00 FROM THE CAPITAL IMPROVEMENT FUND, AND FURTHER TO AUTHORIZE THE EXPENDITURE OF THE SAID TOTAL FOR THE RESURFACING OF A PORTION OF HAMILTON AVENUE FROM THE BOULEVARD TO TERRACE AVENUE" be now passed on second and final reading and the Borough Clerk be and is hereby authorized and directed to publish said Ordinance, same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

 

ORDINANCE NO. 1849:

BE IT RESOLVED that an Ordinance entitled "AN ORDINANCE TO SUPPLEMENT CHAPTER 178 ENTITLED "LITTERING" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS SO AS TO SPECIFICALLY INCLUDE THEREIN A PROHIBITION AGAINST THE SURRENDER OR ABANDONMENT OF A SHOPPING CART ON ANY PRIVATE OR PUBLIC PREMISES WITHIN THE BOROUGH OF HASBROUCK HEIGHTS EXCEPT THE PREMISES UPON WHICH IS LOCATED THE COMMERCIAL ENTERPRISE FROM WHICH THAT CART WAS TAKEN, PROVIDING FOR THE COLLECTION AND STORAGE OF CARTS SO SURRENDERED OR ABANDONED IN VIOLATION OF THAT PROHIBITION, PROVIDING A FEE FOR SUCH COLLECTION AND STORAGE, AND PROVIDING FOR PENALTIES FOR THE VIOLATION OF ANY OF THE TERMS THEREOF" be now passed on second and final reading and the Borough Clerk be and is hereby authorized and directed to publish said Ordinance, same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

ORDINANCE NO. 1850:

BE IT RESOLVED that an Ordinance entitled "AN ORDINANCE TO AMEND SECTION 275-37 ENTITLED "ENFORCEMENT" OF CHAPTER 275 ENTITLED "ZONING" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS SO AS TO FURTHER SPECIFY THOSE OFFICIALS IN CHARGE OF THE ENFORCEMENT OF THAT CHAPTER, SO AS TO CREATE THE OFFICE OF A ZONING ENFORCEMENT OFFICER AND DEFINING THE DUTIES THEREOF AND SO AS TO REDEFINE THE DUTIES OF OTHER BOROUGH OFFICIALS IN RELATION THERETO" be now passed on second and final reading and the Borough Clerk be and is hereby authorized and directed to publish said Ordinance, same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

On motion by Councilman Wassberg, seconded by Councilman Pepe, and unanimously carried, the foregoing Ordinances for final adoption were approved.

 

MISCELLANEOUS FROM PUBLIC:

Mayor Torre waived the public portion of the meeting.

 

RECESS FOR CAUCUS:

The Governing Body recessed for Caucus.

 

ADJOURN:

There being no further business to come before the Mayor and Council, the meeting was adjourned.
