BOROUGH OF HASBROUCK HEIGHTS

M I N U T E S

February 8, 2000

 

A Regular Meeting of the Mayor and Council of the Borough of Hasbrouck Heights was held on February 8, 2000 at 8 p.m. at the Masonic Hall, 200 Division Avenue, corner of the Boulevard, Hasbrouck Heights, New Jersey.

Mayor Torre stated that the meeting complied with the Sunshine Law, due notice having been made to all members by personal service on December 28, 1999 and to The Observer, The Record and the Herald News on December 28, 1999.

ROLL CALL: Present: Councilman Andrew Link III, Councilman Herbert D. Heeren, Councilman Justin A. DiPisa, Councilman Garrett R. Pepe, Councilwoman Marlene Verrastro, Councilman John Wassberg

 

SALUTE TO THE FLAG AND PLEDGE OF ALLEGIANCE: Mayor Torre led in the Salute to the Flag and Pledge of Allegiance.

 

COMMUNICATIONS: Letter from Congressman Steven Rothman regarding Cablevision (copy attached)

Mayor Torre informed the public that negotiations with Cablevision were ongoing, including a discount for senior citizens. He felt it appears it is becoming a monopoly, as another Cable company was invited to come into Hasbrouck Heights and refused. Some updates received are public access on Channel 19 and 20, and all new buildings will become cable ready. He hoped that in the near future the 80 towns that are serviced by Cablevision will be able to get together to have more say in their cable service.

He next reported that the council has received a lot of correspondence on the quality of mail delivery in Hasbrouck Heights, has notified Congressman Rothman and that the Postmaster has been invited to the next council meeting on February 22.

 

APPOINTMENTS:

Moving off the agenda, he asked for a motion on the following resolutions:

45. Authorizing Promotion of George Shihanian to Lieutenant

46. Authorizing Promotion of Richard Malone to Lieutenant

47. Authorizing Promotion of Jeffrey Smith to Lieutenant

On a motion by Councilman Heeren, seconded by Councilman Wassberg, and unanimously carried, the foregoing resolutions were approved.

The families of each of the appointed were asked to come forward in the order as read, the Oath of Office was administered to each of them, and pictures and applause followed.

Mayor Torre invited anyone wishing to could leave at this time.

 

APPROVAL OF MINUTES:January 11, 2000 and January 25, 2000

On a motion by Councilman DiPisa, seconded by Councilman Heeren, and unanimously carried, the Minutes of January 11, 2000 and January 25, 2000 were approved.

 

BILLS: Be It Resolved that the claims and accounts amounting to $2, 191, 091.82 specified in the schedule hereto annexed, having been examined and approved by the Finance Commissioner, or his Deputy, be paid and that warrants be issued therefor.

On a motion by Councilwoman Verrastro, seconded by Councilman DiPisa, and unanimously carried, the foregoing resolution was adopted.

 

CONSENT AGENDA:
37. Authorizing Raffle Licenses for Lincoln School PTA

On a motion by Councilman Pepe, seconded by Councilman Wassberg, and unanimously carried, the Consent Agenda was approved.

 

RESOLUTIONS:

Councilman Link questioned Resolution No. 39, asking that the word "demand" was strong, and should it be changed to "request." Further discussion continued and the consensus of opinion was to use the word "demand."

On a motion by Councilman Link, seconded by Councilman Pepe, and unanimously carried, the foregoing Resolutions were adopted (Resolutions attached).

 

APPOINTMENTS: Michele Yerovi to the Ambulance Auxiliary

On a motion by Councilwoman Verrastro, seconded by Councilman DiPisa, and unanimously carried, the foregoing appointment was approved.

 

APPOINTMENTS: Karen Warren as School Crossing Guard

On a motion by Councilman Pepe, seconded by Councilwoman Verrastro, and unanimously carried, the foregoing appointment was approved.

 

ORDINANCE(S) ON INTRODUCTION:

ORDINANCE No. 1889:

BE IT RESOLVED that an Ordinance entitled "AN ORDINANCE TO PROVIDE FOR THE ACQUISITION OF A NEW HIGH PRESSURE SEWER AND CATCH BASIN VACUUM CLEANER MOUNTED ON A SINGLE DUTY TRUCK CHASSIS TOGETHER WITH NECESSARY APPURTENANCES THERETO FOR THE USE OF THE DEPARTMENT OF PUBLIC WORKS OF THE BOROUGH OF HASBROUCK HEIGHTS, TO APPROPRIATE THE TOTAL SUM OF $200,000.00 THEREFOR AND TO AUTHORIZE THE FINANCING OF A PORTION OF THE COST THEREOF IN ACCORDANCE WITH THE PROVISIONS OF THE LOCAL BOND LAW BY THE ISSUANCE OF BONDS OR NOTES NOT TO EXCEED THE TOTAL SUM OF $190,000.00" introduced this date be and the same is hereby passed on first reading and the Acting Borough Clerk be directed to advertise notice of public hearing on said Ordinance to be held at the regular meeting of the Borough Council on February 22, 2000.

ORDINANCE NO. 1890:

BE IT RESOLVED that an Ordinance entitled "AN ORDINANCE TO AMEND AND SUPPLEMENT AN ORDINANCE ENTITLED "AN ORDINANCE TO AUTHORIZE THE SALE PURSUANT TO N.J.S.A. 40A:12-13 OF LANDS AND PREMISES APPEARING ON THE CURRENT ASSESSMENT MAP OF THE BOROUGH OF HASBROUCK

HEIGHTS AS LOT 24.01 IN BLOCK 161 BEING AN IRREGULARLY SHAPED TRACT OF LAND LYING IN THE SOUTHWEST CORNER FORMED BY THE INTERSECTION OF THE WESTERLY SIDELINE OF NEW JERSEY STATE HIGHWAY ROUTE 17 AND THE SOUTHERLY SIDELINE OF LONGWORTH AVENUE, UNIMPROVED, HAVING A FRONTAGE ON AN IMPROVABLE STREET OF ONLY 25.36 FEET" BEING ORDINANCE NO. 1871 ADOPTED SEPTEMBER 28, 1999 SO AS TO FURTHER PROVIDE FOR THE SUBDIVISION OF A 25 FOOT STRIP TO BE MERGED WITH LOT 31 IN BLOCK 161 IN ORDER TO FACILITATE THE ACQUISITION OF A NECESSARY SEWER EASEMENT introduced this date be and the same is hereby passed on first reading and the Acting Borough Clerk be directed to advertise notice of public hearing on said Ordinance to be held at the regular meeting of the Borough Council on February 22, 2000.

Councilman Link questioned Ordinance No. 1890 on whether this was a buildable lot, and his questions were answered by Borough Attorney Ralph W. Chandless Jr. at which time the councilman did withdraw his objections.

On a motion by Councilwoman Verrastro, seconded by Councilman Wassberg, and unanimously carried, to approve the foregoing Ordinances for Introduction.

 

ORDINANCES ON PUBLIC HEARING:

Mayor Torre opened the meeting to the public for anyone wishing to speak on Ordinances No. 1886 and 1887. There being no one wishing to speak, Mayor Torre closed the public hearing on said ordinances.

 

ORDINANCE NO. 1886

BE IT RESOLVED that an Ordinance entitled: "AN ORDINANCE TO FIX THE SALARY AND COMPENSATION OF CERTAIN EMPLOYEES OF THE DEPARTMENT OF PUBLIC WORKS OF THE BOROUGH OF HASBROUCK HEIGHTS, NEW JERSEY, FOR THE YEAR 2000" be now passed on second and final reading and the Acting Borough Clerk be and hereby authorized and directed to publish said Ordinance same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

 

ORDINANCE NO. 1887

BE IT RESOLVED that an Ordinance entitled: "AN ORDINANCE PURSUANT TO N.J.S.A. 40:8a-5 et seq. TO AUTHORIZE A CONTRACT WITH THE COUNTY OF

BERGEN TO PROVIDE PUBLIC HEALTH SERVICES UNDER THE LOCAL HEALTH SERVICES ACT FOR THE YEAR 2000" be now passed on second and final reading and the Acting Borough Clerk be and hereby authorized and directed to publish said Ordinance, same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

Ona motion by Councilman Link, seconded by Councilman Heeren, and unanimously carried, to approve the foregoing Ordinances on Adoption.

 

ORDINANCE(S) ON CONTINUED PUBLIC HEARING:

ORDINANCE NO. 1888:

BE IT RESOLVED that Ordinance entitled "AN ORDINANCE GRANTING MUNICIPAL CONSENT FOR THE PLACEMENT OF FACILITIES AND THE ESTABLISHMENT OF CABLE TELEVISION SERVICE IN THE BOROUGH OF HASBROUCK HEIGHTS, BERGEN COUNTY, TO CABLEVISION OF OAKLAND, INC." be now continued on public hearing at the regular meeting of the Borough Council on February 22, 2000 at 8:00 p.m.

On a motion by Councilman Wassberg, seconded by Councilman Heeren, and unanimously carried, the foregoing ordinance was continued on public hearing.

 

MISCELLANEOUS FROM PUBLIC: This being the first meeting of the month, the Mayor dispensed with opening the meeting to the public and said that the meeting would be open to the public on February 22.

 

ADJOURN:

There being no further business to be conducted by the Mayor and Council, the meeting was adjourned.
