BOROUGH OF HASBROUCK HEIGHTS

M I N U T E S

December 11, 2001


A Regular Meeting of the Mayor and Council of the Borough of Hasbrouck Heights was held on December 11, 2001 at 8 p.m. at the Masonic Hall, 200 Division Avenue, corner of the Boulevard, Hasbrouck Heights, New Jersey.

Mayor Torre stated that the meeting complied with the Sunshine Law, due notice having been made to all members by personal service on January 1, 2001 and to The Observer, The Record and the Herald News on January 1, 2001.

 

ROLL CALL: Present: Mayor William J. Torre, Councilman Andrew Link III, Councilman Herbert D. Heeren, Councilman Garrett R. Pepe, Councilwoman Verrastro, Councilman John Wassberg

Absent: Councilman Justin DiPisa

 

SALUTE TO THE FLAG AND PLEDGE OF ALLEGIANCE: Mayor Torre led in the Salute to the Flag and Pledge of Allegiance.

 

APPOINTMENTS:
James Miller from Patrolman to Sergeant

Charles Lesho from Patrolman to Sergeant

On a motion by Councilwoman Verrastro, seconded by Councilman Wassberg, and unanimously carried, the foregoing Appointment was approved.

 

RESOLUTIONS:
180. Authorizing Promotion of Patrolman James Miller to Sergeant

181. Authorizing Promotion of Patrolman Charles Lesho to Sergeant

A motion was made by Councilwoman Verrastro, seconded by Councilman Pepe, and unanimously carried, the foregoing Police Promotions were approved.

Mayor Torre invited each police officer and his family to come forward, Police Commissioner Verrastro assisted. Mayor Torre swore in and read the Oath of Office to each police officer which they accepted and signed.

 

PROCLAMATION:
Edward Mahonchak, World War II Veteran

A proclamation was presented to Edward Mahonchak for his distinguished service during World War II by Mayor Torre with Councilman Heeren assisting. (Copy of proclamation attached)

 

PRESENTATION OF CERTIFICATES:

2001 Division 5 Soccer Champions - Firebirds

2001 Division 3 Soccer Champions - Arsenal

2001 Aviators Soccer Boys U11 First Place

Certificates were presented to each team member for the above teams for championship seasons by Mayor Torre, assisted by Deputy Commissioner of Recreation Verrastro. MINUTES: (October 23, 2001 and November 13, 2001)

On a motion by Councilman Pepe, seconded by Councilwoman Verrastro, and carried, except for Councilman Wassberg abstaining as he was absent from the meeting, the Minutes of October 23, 2001 were approved. The Minutes of November 13, 2001 were held to the next meeting as Councilman Link asked to have them corrected to show his presence at that meeting, though arriving late.

 

PETITIONS: None

COMMUNICATIONS: The following correspondence has been received as of this date:

182. Letter from Carl W. Block, Mayor of Stafford Township and N.J. State League of Municipalities new president, introducing himself and announcing upcoming important programs.

183. Letter from Robert C. Shinn Jr., State of New Jersey Dept. of Environmental Protection regarding the Clean Communities grant program and if the state legislature does not enact legislation to continue the program, it will become the responsibility of the municipality. He asked for support of this legislation.

184. Letter from William G. Dressel, Jr. Executive Director of the N.J. State League of Municipalities to contact Majority Leader Paul DiGaetano at 201-933-0533 and impress the importance of passing the Clean Communities bill A-2413.

Mayor Torre asked if any member of the Governing Body wished to have any particular item read into the record, with no response, he asked for a motion to accept the correspondence and place the same on file. A motion was made by Councilwoman Verrastro, seconded by Councilman Wassberg, and unanimously carried, the foregoing Correspondence was accepted.

 

BILLS:

BE IT RESOLVED that the claims and accounts amounting to $1,434,885.67 specified in the schedule hereto annexed, having been examined and approved by the Finance Commissioner, or his Deputy, be paid and that warrants be issued therefor.

BE IT RESOLVED that an Ordinance entitled "AN ORDINANCE TO SUPPLEMENT CHAPTER 275 ENTITLED "ZONING" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS TO PROHIBIT CERTAIN SEXUALLY ORIENTED ENTERTAINMENT AS AN ACCESSORY TO PERMITTED USES THAT ARE OPEN TO THE PUBLIC WITHIN ANY ZONE IN THE BOROUGH OF HASBROUCK HEIGHTS AND TO DEFINE CERTAIN TERMS IN CONNECTION WITH THAT PROHIBITION" introduced this date be and the same is hereby passed on first reading and the Borough Clerk be directed to advertise notice of public hearing on said Ordinance to be held at the regular meeting of the Borough Council on December 27, 2001.

BE IT RESOLVED that an Ordinance entitled "AN ORDINANCE TO AMEND THE SCHEDULE OF DISTRICT USE REGULATIONS OF CHAPTER 275 ENTITLED "ZONING" OF THE CODIFICATION OF ORDINANCES OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS IN RESPECT TO PERMITTED PRINCIPAL USES IN THE B-1 "CENTRAL BUSINESS DISTRICT ZONE" introduced this date be and the same is hereby passed on first reading and the Borough Clerk be directed to advertise notice of public hearing on said Ordinance to be held at the regular meeting of the Borough Council on December 27, 2001.

 

ORDINANCE NO. 1953:

BE IT RESOLVED that an Ordinance entitled "AN ORDINANCE TO SUPPLEMENT CHAPTER 275-6 ENTITLED "DEFINITIONS" OF ARTICLE II ENTITLED "WORD USAGE AND DEFINITIONS" OF CHAPTER 275 ENTITLED "ZONING" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS SO AS TO INCLUDE AMONG THE WORDS AND PHRASES DEFINED THEREIN THE PHRASE "COMMUNITY-ORIENTED BUSINESS" AS SUCH PHRASE APPLIES TO PERMITTED BUSINESSES IN THE B-1 CENTRAL BUSINESS DISTRICT ZONE" introduced this date be and the same is hereby passed on first reading and the Borough Clerk be directed to advertise notice of public hearing on said Ordinance to be held at the regular meeting of the Borough Council on December 27, 2001.



ORDINANCE NO. 1954:

BE IT RESOLVED that an Ordinance entitled "AN ORDINANCE SUPPLEMENTING ARTICLE VI ENTITLED "RESTAURANTS AND DINING ROOMS" OF CHAPTER 84 ENTITLED "ALCOHOLIC BEVERAGES" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS SO AS TO PERMIT THE CONSUMPTION OF BEER AND WINE BY CERTAIN CUSTOMERS OF CERTAIN UNLICENSED RESTAURANTS AND DINING ROOMS WITHIN THE CENTRAL BUSINESS DISTRICT OF THIS BOROUGH UNDER CERTAIN SPECIFIED CONDITIONS" introduced this date be and the same is hereby passed on first reading and the Borough Clerk be directed to advertise notice of public hearing on said Ordinance to be held at the regular meeting of the Borough Council on December 27, 2001.

Mayor Torre asked the council members to please defer any questions on these ordinances to the borough attorney prior to the public hearing.

On a motion by Councilwoman Verrastro, seconded by Councilman Pepe, and unanimously carried, the foregoing Ordinances on Introduction were accepted.

 

ORDINANCE(S) ON CONTINUED PUBLIC HEARING:

Mayor Torre opened the meeting to the public for anyone wishing to speak on Ordinance No. 1949. This ordinance is to be continued on public hearing until approval is received from Trenton.

ORDINANCE NO. 1949:

BE IT RESOLVED that an ordinance entitled "AN ORDINANCE PURSUANT TO N.J.S.A. 40:48B-14 ET SEQ. TO AMEND AND SUPPLEMENT ARTICLE V ENTITLED "JOINT MUNICIPAL TAX ASSESSOR" OF CHAPTER 45 ENTITLED "OFFICERS AND EMPLOYEES" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS SO AS TO PROVIDE THAT THE OFFICE OF JOINT MUNICIPAL TAX ASSESSOR AS IS HITHERTO ESTABLISHED MAY ALSO SERVE THE TOWNSHIP OF ROCHELLE PARK UPON ITS ADOPTION OF THE NECESSARY ORDINANCE OR RESOLUTION CREATING THE SAME AND UPON ITS ENTRY INTO AN AGREEMENT OF CONDITIONS FOR THE OPERATION OF THE SAME WITH THIS BOROUGH AND THE TOWNSHIP OF SOUTH HACKENSACK" be continued on public hearing and notice of public on said ordinances to be held at a regular meeting of the Borough Council on December 27, 2001 at 8 p.m.

On a motion by Councilman Pepe, seconded by Councilman Heeren, and unanimously carried, the foregoing Ordinance was continued on public hearing.

 

MISCELLANEOUS FROM PUBLIC:
As Mayor failed to announce that there would be no public comment at the beginning of the council meeting, he asked the council if they would agree to permit public discussion at this meeting.

Debra Stanton, 95 Prospect Street, asked about the overnight parking residential permits and Mayor Torre said it was referred to the Police Committee. Ms. Stanton wanted it to be known that she was in favor of keeping the overnight parking ordinance as it now stands.

 

RECESS FOR CAUCUS:

Mayor Torre announced that the meeting would be recessed for Caucus.

 

ADJOURN:

There being no further business to be conducted by the Mayor and Council, the meeting was adjourned.
