BOROUGH OF HASBROUCK HEIGHTS

M I N U T E S

July 9, 2002

A Regular Meeting of the Mayor and Council of the Borough of Hasbrouck Heights was held on July 9, 2002 at 8 p.m. at the Masonic Hall, 200 Division Avenue, corner of the Boulevard, Hasbrouck Heights, New Jersey.

Councilman DiPisa (as Mayor Torre had to leave and would be coming back) stated that the meeting complied with the Sunshine Law, due notice having been made to all members by personal service on January 1, 2002 and to The Observer, The Record and the Herald News on January 1, 2002.

ROLL CALL: Present: Councilman Andrew Link III, Councilman Herbert D. Heeren, Councilman Justin A. DiPisa, Councilman Garrett R. Pepe, Councilwoman Marlene Verrastro, Councilman John Wassberg

Absent: None

 

SALUTE TO THE FLAG AND PLEDGE OF ALLEGIANCE: Councilman DiPisa led in the Salute to the Flag and Pledge of Allegiance.

 

COMMUNICATIONS:

1. Letter from Dennis J. Oury, Esq., Oury & Mizdol, P.C., Counsellors at Law, 411 Hackensack Avenue, Hackensack, NJ 07601, regarding The Ground Round, Inc. to Bayside Restaurant Group, Inc. Plenary Retail Consumption License #0225 33 005 005 addressed to Rose Marie Sees, Borough Clerk which read as follows: "Kindly accept this letter as formal notification of my clients’ withdrawal of the pending transfer application regarding the above referenced license. Should you require anything further, please do not hesitate to call."

On a motion by Councilwoman Verrastro, seconded by Councilman Wassberg, and unanimously carried, the foregoing correspondence was accepted.

 

MINUTES: (May 28, 2002)

A motion by Councilwoman Verrastro, seconded by Councilman Wassberg, the foregoing Minutes were approved.

 

BILLS:

BE IT RESOLVED that the claims and accounts amounting to $1,604,720.93 specified in the schedule hereto annexed, having been examined and approved by the Finance Commissioner, or his Deputy, be paid and that warrants be issued therefor.

On a motion by Councilman Pepe, seconded by Councilwoman Verrastro, and unanimously carried, the foregoing Resolution was adopted.

Mayor Torre, who returned to the meeting during the reading of the Resolutions, made several comments on these Resolutions before entertaining a motion to accept. Regarding the "Blue laws" he stressed the need for Resolution No. 124, to keep the law as it is, to keep the "day of rest." Resolution No. 125, requiring estimated tax bills to be prepared, was due to the lateness of passing the State Budget, an inconvenience and unnecessary expense, but required.

On a motion by Councilman Wassberg, seconded by Councilman Heeren, and unanimously carried, the foregoing Resolutions were approved. (Copies attached.)

 

PRESENTATION:
Members of the American Legion Captain James B. Scarr Post 106 presented American Flags with 46 Stars to the Mayor and Council with the hope of their use in the new Municipal Building Complex

RESIGNATIONS: Daniel D’Alessandro from Engine Company One Effective June 1, 2002

On a motion by Councilman Pepe, seconded by Councilman Wassberg, and unanimously carried, the foregoing Resignation was accepted with regret.

ORDINANCE(S) ON PUBLIC HEARING:

Mayor Torre opened the meeting to the public for anyone wishing to speak on Ordinance No. 1968, Ordinance No. 1969 or Ordinance No. 1970. There being no one wishing to speak, the public hearing was closed.

 

ORDINANCE NO. 1968:

BE IT RESOLVED that an Ordinance entitled ""AN ORDINANCE TO AMEND AND SUPPLEMENT AN ORDINANCE ENTITLED "AN ORDINANCE TO APPROPRIATE THE SUM OF $9,500,000.00 TO PROVIDE FOR THE CONSTRUCTION OF A NEW MUNICIPAL BUILDING ON THE BOULEVARD TO INCLUDE THE BOROUGH'S ADMINISTRATIVE OFFICES, A NEW FREE PUBLIC LIBRARY AND A SENIOR CITIZENS' CIVIC CENTER AND FOR THE CONSTRUCTION OF A NEW PUBLIC SAFETY BUILDING ON HAMILTON AVENUE TO INCLUDE THE BOROUGH'S MUNICIPAL COURT, FIRE DEPARTMENT, POLICE DEPARTMENT AND OFFICE OF   EMERGENCY MANAGEMENT, TO APPLY TO THE COST THEREOF $4,500,000.00 IN INSURANCE PROCEEDS AND A GRANT FROM COMMUNITY DEVELOPMENT IN THE SUM OF $339,156.00, AND TO AUTHORIZE THE FINANCING OF THE COST THEREOF IN ACCORDANCE WITH THE PROVISIONS OF THE LOCAL BOND LAW BY THE ISSUANCE OF BONDS OR NOTES NOT TO EXCEED THE SUM OF $4,427,000.00 BEING ORDINANCE NO. 1944 ADOPTED ON AUGUST 14, 2001, SO AS TO INCREASE BY THE SUM OF $703,723.00 THE TOTAL AMOUNT APPROPRIATED TO $10,203,723.00 AND SO AS TO PROVIDE THAT THE PROCEEDS OF A GRANT FROM THE NEW JERSEY EDUCATIONAL FACILITIES AUTHORITY IN THE SUM OF $703,723.00 TO BE APPLIED TO MEET THAT APPROPRIATION" be now passed on second and final reading and the Borough Clerk be and is hereby authorized and directed to publish said Ordinance, same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

 

ORDINANCE NO. 1969:

BE IT RESOLVED that an Ordinance entitled "AN ORDINANCE TO AMEND AND SUPPLEMENT CERTAIN PROVISIONS OF CHAPTER 222 ENTITLED "SEWERS," CHAPTER 236 ENTITLED "STREETS AND SIDEWALKS," AND CHAPTER 133 ENTITLED "FEES" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS SO AS TO INCREASE CERTAIN OF THE FEES CHARGED BY THE BOROUGH IN RESPECT TO PERMITS TO MAKE CONNECTIONS INTO THE PUBLIC SEWERAGE SYSTEM AND IN RESPECT TO APPLICATIONS FOR CERTAIN ROAD OPENINGS IN ORDER THAT SUCH FEES MORE ADEQUATELY ABIDE THE COSTS OF THE BOROUGH IN CONNECTION THEREWITH" be now passed on second and final reading and the Borough Clerk be and is hereby authorized and directed to publish said Ordinance, same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

 

ORDINANCE NO. 1970:

BE IT RESOLVED that an Ordinance entitled "AN ORDINANCE TO SUPPLEMENT THE PROVISIONS OF CHAPTER 28 ENTITLED "FIRE DEPARTMENT" OF THE CODE OF THE BOROUGH OF HASBROUCK HEIGHTS SO AS TO PROVIDE THEREIN FOR THE ESTABLISHMENT AND OPERATION OF A JUNIOR AMBULANCE AND FIREFIGHTERS SQUAD" be now passed on second and final reading and the Borough Clerk be and is hereby authorized and directed to publish said Ordinance, same to be published in The Observer, a newspaper circulating and published in the Borough of Hasbrouck Heights.

On a motion by Councilman Pepe, seconded by Councilman DiPisa, and unanimously carried, the foregoing Ordinances on Public Hearing were approved.

 

MISCELLANEOUS FROM PUBLIC: This being the first meeting of the month, the Mayor dispensed with opening the meeting to the public and said that the meeting would be open to the public on July 23, 2002.

 

RECESS FOR CAUCUS

Mayor Torre announced that the meeting would be recessed for Caucus.
